Getly respects the intellectual property rights of creators and expects all users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and respond promptly to valid takedown notices. If you believe that content on Getly infringes your copyright, this page explains how to report it and what happens next.
1. Submit a Notice
Send a DMCA takedown notice to dmca@getly.store with the required information listed below.
2. We Review
Our Trust & Safety team reviews the notice and, if valid, removes or disables access to the reported content.
3. Seller Notified
We notify the seller whose content was removed and provide them with a copy of the takedown notice.
4. Counter-Notification
If the seller believes the removal was a mistake, they can submit a counter-notification to have the content restored.
Filing a Takedown Notice
To submit a DMCA takedown notice, send an email to dmca@getly.store with the following information:
Identification of the copyrighted work. A description of the copyrighted work you believe has been infringed. If multiple works are involved, provide a representative list.
Identification of the infringing material. The URL(s) or other specific location on Getly where the material you believe is infringing can be found. Provide enough detail for us to locate the content.
Your contact information. Your full legal name, mailing address, telephone number, and email address.
Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Signature. Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).
Important
Filing a false DMCA takedown notice is a serious matter. Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees. Please ensure your claim is legitimate before submitting.
What Happens After You File
Upon receiving a valid DMCA takedown notice, we will:
Remove or disable access to the allegedly infringing material promptly.
Notify the user who posted the content and provide them with a copy of the takedown notice.
Record the takedown in our internal system for tracking repeat infringers.
If the notice is incomplete or does not meet the requirements above, we may request additional information before taking action.
Counter-Notification
If you are a seller whose content was removed and you believe the removal was made in error or that you have the right to use the material, you may submit a counter-notification. Send your counter-notification to dmca@getly.store with the following:
Identification of removed material. A description of the material that was removed and the URL where it previously appeared.
Good faith statement. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
Your contact information. Your full legal name, mailing address, telephone number, and email address.
Consent to jurisdiction. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Getly may be found), and that you will accept service of process from the person who filed the original takedown notice.
Signature. Your physical or electronic signature.
After a Counter-Notification
Upon receiving a valid counter-notification, we will:
Forward the counter-notification to the original complainant.
Inform the complainant that the removed material may be restored in 10 to 14 business days.
Restore the material within 10 to 14 business days unless the complainant notifies us that they have filed a court action to restrain the allegedly infringing activity.
Repeat Infringer Policy
Getly maintains a repeat infringer policy in accordance with the DMCA. We will terminate the accounts of users who are determined to be repeat infringers. Our policy is as follows:
First offense: The infringing content is removed and the user receives a warning.
Second offense: The infringing content is removed and the user's account is placed on probation with limited upload capabilities.
Third offense: The user's account is permanently terminated and they are prohibited from creating new accounts.
We reserve the right to terminate accounts on the first offense in cases of egregious or clearly intentional infringement.
Proactive Protection
In addition to responding to takedown notices, Getly takes proactive steps to protect creators' intellectual property:
Automated monitoring for content that may infringe on known copyrighted works.
A reporting system that allows any user to flag potentially infringing content directly from product pages.
Regular audits of newly listed products by our Trust & Safety team.
